Today, my new landlord and lettings agent made an illegal entry into my house. Unfortunately, at the time my boyfriend was buck naked, smoking a joint on the sofa, surrounded by the cats we aren't supposed to have. FML

It doesn't matter how many illegal things he was doing. Anything seen or any evidence was taken illegally and you cannot be prosecuted through it.

I bet if he passes that joint everything will be fine!

Well, ydi, but you're in luck because you could charge them with breaking and entering. That being said, I don't know how serious they take accusations about someone having marijuana, so I do suggest that you get rid of the pot at least. You can try saying you're just cat sitting for a friend, but I doubt that'd work. Regardless, at least then you'd only be getting evicted and no one would be charged with possession.

I love everyone posting US laws that wouldn't apply to this FML as it's in UK. Hope google made you all feel smart.

He can't do anything. It's evidence he gained on an illegal entry with no prior notice which is required.

Actually, by UK law, the landlord had no right to do that. A landlord cannot enter his/her tenant's property without consent, unless in the case of an emergency. The only real exception to this is routine maintenance and repair, in which case, reasonable notice has to be given first. Under no circumstance is a landlord free to walk into the property without warning; it doesn't matter what's written in the contract, it's a violation of tenant law.

You should move somewhere else then. Mine can not enter unless I have prior notice, and the fact that yours enters whenever she likes, unless its a room you are renting in her own home, is invasion of privacy.
