Yes that’s nepotism but no it is not illegal. Nepotism is pulling strings to get a relative a job. That is not illegal. The guy being fired because he is old is likely ageism and would be illegal as it is discrimination. However if OP is old enough he can no longer perform his duties in a timely manner then it wouldn’t be illegal to let home go as he is no longer meeting performance standards.

Bring it up with HR for wrongful firing to appeal the decision, and "too old and lame" is not a valid reason for firing. Stealing, bad metrics, smoking, rude behavior, sleeping on the job, not showing up are. Too old and lame aren't.
