If you were in a divorce and have legal custody of the children, there should be some legal documents to that effect. Those should suffice to prove that you can list your children as dependents for tax purposes.

I work for H&R Block. It's simple, all you need to do is send in the divorce papers showing you are the custodial parent and make sure it is not his year to claim them and the IRS will take care of the rest. You will get your money and he will have to pay them back. The downside is that you'll have to mail in your return rather than e-filing, so it can take several weeks, but it's better than the alternative.
