I'm going to say it's both of your faults. If I'm in the passenger seat with my friends or anyone and they're on their phones, I will take it from them. I don't care how important it is or if they kick me out. You are not going to risk both of our lives just because you couldn't wait to be on your phone. If it's so urgent, pull over somewhere, but do not drive while you're on your phone.
