Today, my husband who asked for a divorce four days ago announced his engagement on Facebook. His new woman's profile picture is my engagement ring. FML

the ring is actually your personal property, as is your wedding band. the only time it's required that you give it back, is if YOU break off the engagement prior to the marriage. It's considered a form of contract until the wedding day, and upon the marriage becoming official, the ring is considered a gift to the bride/wife. The only time that a judge might make an exception with rings is if the rings are a family heirloom from his side of the family. So... I'd be calling the police and filing a theft charge against him asap.

No honey, it's not your engagement ring. It stopped being your engagement ring the moment you gave it back to him. Why would you give back the ring in the first place? That was just stupid. Even if you didn't want to keep it as a reminder of the marriage, it was yours to sell. Now you've forfeited it as a gift and even with a lawsuit, it's highly unlikely you'd ever get it back. What kind of woman accepts a ring from the still legal marriage of her boyfriend? Really it sounds like you're better off without him, and that they deserve each other.

He may have just taken (stolen) it from her jewelry box or whatever.

FYL... and the engagement and wedding rings are supposed to remain YOUR property! If you gave them back to him willingly, YDI. If he stole them, sue for them in the divorce. ... Screw it, sue for them anyway, even if you did misguidedly give them to him. They're yours.
