I don't think that infidelity penalty stands in most states anymore. Divorce is no-fault these days.

Nj is community property state, you split everything acquired during the marriage. Who makes less may have a case for alimony or limited durational depending on length of the marriage. Cheating really has nothing to do with the outcome, at least in jersey.
