Yep, ya ****** up there.
That is outstanding. Next time offer me a few cold ones. I will bring a good saw over and lay it down in a safe spot. I make this offer because there really is nothing like the feeling of one starting into a long back cut, seeing he heartwood come flying off the bar, then one of natures giants letting out that goan as they come crashing to the ground. It is a wonderfull feeling.

Pay up. As I understand the law, this is your responsibility. I have a hunch you're giving him a lot of grief and not dealing with this as the law -- and such things as basic decency, self-responsibility, and owning up to the consequences of action or inaction -- demands of you. Otherwise, he wouldn't need to take you to court (where I would bet a lot you're going to lose big time). Insurance companies work out this kind of thing between themselves all the time. You shouldn't have to be dragged into court to be made to take care of the result of big-time negligence on your part. And next time, hire an arborist.
I completely agree. OP clearly isn't owning up to the fact that he caused the damage to his neighbor's house.
Don't either of you have homeowners insurance? YDI.
