Today, I decided to clear up some storm damage. I carefully cut a tree that was threatening to fall on my house. It fell on my neighbor's house instead. He's taking me to court for damages. FML

Maybe leave that to the people who know what they're doing?

why does he have to take you to court? why can't you just agree to pay for the damages?

That is outstanding. Next time offer me a few cold ones. I will bring a good saw over and lay it down in a safe spot. I make this offer because there really is nothing like the feeling of one starting into a long back cut, seeing he heartwood come flying off the bar, then one of natures giants letting out that goan as they come crashing to the ground. It is a wonderfull feeling.

You think your neighbor ought to just suck it up and call it an "oops" on your part? Why do you need to get the courts involved? Your insurance companies ought to be able to handle it easily enough since it is clearly your fault. Don't waste money on the lawyers.

next time push the tree on the road then its the city's problem to clean up

Pay up. As I understand the law, this is your responsibility. I have a hunch you're giving him a lot of grief and not dealing with this as the law -- and such things as basic decency, self-responsibility, and owning up to the consequences of action or inaction -- demands of you. Otherwise, he wouldn't need to take you to court (where I would bet a lot you're going to lose big time). Insurance companies work out this kind of thing between themselves all the time. You shouldn't have to be dragged into court to be made to take care of the result of big-time negligence on your part. And next time, hire an arborist.

well stated 68. You sound like a lawyer yourself. and op should take full responsabity of what happened becuz it's clearly his/her fault.

I completely agree. OP clearly isn't owning up to the fact that he caused the damage to his neighbor's house.

Don't either of you have homeowners insurance? YDI.
