Hey guys OP here (I had posted anonymously without an account before). To clarify what happened, I was about a car's length away from the SUV in front of me, stopped at a red light. I was hit by an SUV and I had a Saturn sedan... that's why it ended up crunched and totaled. When he hit me I flew backwards and my seat lock failed, collapsing my seat into the back bench. I hit my head and blacked out. When I regained consciousness my foot had come off my brake, causing me to run into the SUV in front of me with the impact. I immediately put my car in park and put on my E lights when I woke up. Paramedics were eventually called onto the scene after police came to check me out. I was having an anxiety attack right after it occurred, so was not in a mental state to call 911, and the guy who hit me's phone died just after he hit me. He was super concerned and took full responsibility, and yelled at the lady in front of us for not checking if we needed paramedics before calling 911. My air bag did not deploy, but I was checked out by paramedics and got a ride to the hospital. I'm doing alright now, with just a mild concussion and a sprained neck. Thank you all for the concern! :) now it's just about figuring out getting money together to get another car!

And you're making a correlation mistake. Texting is not more common because talking is illegal, as I'm sure texting while driving is illegal as well in most places. We text more because our phones now have full keyboards, and we are on several social networks that are text based.
Funny thing about the whole 'distraction because of the phone thing'. They invented hands free sets for that, yet the phone call is still just as distracting. The point is not the fact you are distracted by the phone call, but because you don't have both hands on the steering wheel.
Good Samaritan laws are supposed to protect people who choose to intervene and something happens to the victim beyond the rescuers knowledge or abilities. I am trained in first aid and CPR and know this. You are never required to render aid.
Yes this is how good Samaritan laws work but after some reading it seems that in some states and quebec there are"duty to act" laws.
Definitly an FML for your injuries and car. What I don't get is how, with a three car incident with at least one totaled car (guessing car behind you totaled also), police and aid wern't called even if the lady in front didnt care to do it.
Really? I definetly would be more concerned if you're hurt than if I got a scratch on my car

(Continued) car. Insurance calls between the responsible party and myself are in the works, just slow going with the holidays. Thankfully I'm not required back at work until January 9th so I have time to find a replacement!!!
Glad you're okay, OP! I was also in a car-totaling accident a few years ago that took place right around the holidays. The other party's insurance co. dicked around for weeks before finally having to assume full liability, but until that happened, they did pay for a (cheap POS of a) rental car. If you can get them to cover a rental so you at least have some time to browse dealerships and get to and from work while they're looking for ways to avoid responsibility, go for it! You shouldn't have to be rushed into buying a new car because of someone else's bad call.
Smells like a lawsuit to me.

She could be charged with Failure to Render Aid. Then you can sue her for negligent bitchitude.
Texting and driving is just as bad as drunk driving. My mom got hit by someone texting and driving. Luckily she's okay now. Hope you're okay OP.
