I'm pretty sure OP can't sue them. The neighbor probably can though. And OP can refuse payment.
Damn, that sucks. I wonder though if that other tree may have been infected as well, and if that were the case, then they may have done that family a favor. If not, then they are completely useless. Then again, they still sound pretty useless.
Yea if the tree service was called to remove a diseased tree and well the owner was obviously not present and did not give an accurate enough description.. Then maybe the other tree was more at risk. Still I can't ever see not being present while I have something like that going on at my home..
