But wouldn't the collision points on either car hint at who hit who? Even if he T-boned you so hard that you ended up facing him in a T-bone position, the whole front of his car would be totally destroyed, where your car would have the most damage on one side. Maybe I'm thinking about it wrongly.
I investigate traffic accidents like this for a living. There will be a lot of evidence in the roadway, in the damage of the cars, and even stored in the SDM (airbag module) of the cars. Any competent investigation will have to look at all of that in order to reach conclusions that are supported by both the evidence and science. For now - take a ton of pictures of both vehicles, both overall shots and closeups of the damage and be sure to put a tape measure in the shots for scale. If the airbags in either vehicle deployed, or if either one is a GM vehicle even without a deployment, be sure you have your insurance company save the SDMs even if they allow the cars to be scrapped/sold. Two years from now when the cars are gone and the case goes to trial, you'll be glad you did.
I would also like to add about taking pictures of the driver of the other vehicle as well. Just so they don't come back claiming injures when they were perfectly fine at the scene. Happened to myself one time but I had pictures of him walking around and laughing at how he plowed right into us before the cops took him away to give him a drug test.
Holy cow, the exact same thing happened to my fiancé and I today. My advice, which the police suggested we do, is to let the insurance company take care of it. They'll analyze both vehicles and eventually find out he was guilty.
in some states if the police are called they will give citations for drivers that cause accidents because they are distracted or not following laws. and a police report carries a lot of weight with insurance companies.
Dashcams, gotta have one
I've been there before OP. You're ******.

You should explain what happened because usually the actions leading up to the accident can help explain what happened. Also there may be marks on the pavement to explain tire movement.
I hate people that can't take responsibility for their actions.
