It's not her job to research it. Legally the broker has to tell you about conditions like this, and since they did not, they legally have to buy the house back.
Health first, money and property second. Do what you must to protect your family's health.

You may be able to claim damages against your real estate agent. Some states have laws that require disclosure of that sort of thing. That being said, the doctrine of caveat emptor might still f*** you in the end.
Full disclosure. I think you can get out of it, but it will be a pain. Get a lawyer, read up on full disclosure. That is pretty important info from sellers
