what if he thought you knew and that you knew you were invited anyway. Like some of my friends know that they are always welcome to swing by even on Christmas and New Years if im having a party at home. Its just kind of assumed anymore that they are invited

I would have said,"It looks like a great party! Too bad I wasn't invited". If it was a mistake, they'd apologize but if not, hopefully they will feel like an ass for showing you the photos and at least leave you alone.
