Just call up Epic Games and they'll happily refund your money. They are in the Coaltion for App Fairness and are suing Apple for taking money they feel is not theirs. If they really believe that, they'll refund you your $170 because that money is not theirs. Certainly, they would not be hypocrites.
While Richard is often a bit off-color in his responses, if you call them they will refund it without question. I've had people deal with this exact issue. Worst case call your credit card company and they will reverse the charges. Best part is, if you go that route, your brother's account will likely get banned/suspended so you can achieve see revenge.
