Hey, OP here. I was on the road, the other driver was exiting the parking lot and pulled out directly in front of me. I hit the drivers side front fender and door on her car. I had no time to stop. Fortunately for her, I was well under the speed limit otherwise it would have been a lot worse. The police said she was 100% at fault because she didn't make sure it was safe to proceed.

Most places have laws let's say if you were backing up you are automatically at fault. it is worth looking into.
She was exiting the parking lot and turning onto the street. I had right of way. In Manitoba when an accident like this happens, it does not go to court unless the driver is impaired. The insurance company handles everything. However they can and do assign fault in cases like this. The person at fault pays everyone's deductible. Unless she can prove that I was doing something wrong, she will be assigned fault. The collision occurred in the middle of the afternoon, and I wasn't speeding. There was a pedestrian on the sidewalk who told police she pulled out in front of me and was looking the wrong way when she did.
