if you haven't gone to court yet, that's called strict liability and is considered a tort. you would win that court case easily.
It has been proven time and time again that tethered dogs are more likely to behave inappropriately. The majority of dog bites occur that way. In your case it sounds like the dog is lacking training but above all, he's in desperate need of socialization. Stupid people should be held responsible for neglecting their pets - don't worry, OP, you won't be the one paying the court fees.

this idiotic woman has no grounds for legal action. If anyone has grounds to sue, it would be you. You weren't trespassing on her property and she failed to properly restrain her dog, causing personal injury to you. If the **** wants to try and bring you to court, so be it. You have a winning counterclaim, she will lose.
