Today, while on my run, I was attacked by my neighbor's new dog. It apparently didn't like me running past their house and broke free from its chain. I now have stitches and was just told that I'm probably being taken to court for the emotional distress I caused her and the dog. FML

Take pictures of your injury now, in case this goes to court after you've healed. As long as you have a good lawyer, you shouldn't lose. Still, FYL for the hassle and lawyer fees :

Sue. This is one of the easiest court cases to win, Just say. My Neighbor is crazy, I was walking by when her dog broke free of it's chain and attacked me. And now she's threating to sue me? Your Honor take a look at the obvious facts. Common sense can solve this. Oh yeah, and see if you can get the dog put down for the safety of you and others around you. Don't forget to take pictures of your wounds.

If a pet attacks you, you are entitled to damages, not the other way around! Most states have gotten rid of the "one free bite" rule, any pet attacking you is the liability of the owner! Normally I wouldn't advocate suing for one attack but if they are going after YOU for it, have at thee! This is America, getting hurt by someone is like winning the freaking lottery. Hope they took good care of their house, it's probably yours now!

countersue and the best part is since she took yiu to court she will be liable for your court costs as well as hers.

She won't stand a chance in court unless you lawyer is incompetent

the hell with that, I would tell her to back the f*** up and understand that a biting dog is not acceptable and she will be lucky if she even gets to keep the dog at all plus since she failed to restrain her dog she has actually broken criminal laws

Heck no. You have a case, sue her. If an animal bites you, especially if you were not on their property, then the owner is responsible for AT LEAST your medical bills, if not your distress. It's the law.
