That's illegal they can't lay you off then look for someone to fill your position.
I think the real question here is: why did you get laid off?
If they claimed you were being laid off (as opposed to simply fired), isn't that wrongful dismissal?
That's like salt on a wound...that sucks...
I'm pretty sure if their resin for letting you go is lack of work and you are laid off they have to give you the opportunity to come back before they fill your position. If they hire someone else you are entitled to severance pay by law. And after 13 weeks you are owed severance if they haven't called you back.
they can't lay you off then hire someone else, either it was for a different position or you got fired and didnt admit it

I'd reapply for the position just to mess with them.
Actually, if you were "laid off" legitimately, you have the right to that job. Now, are you sure you were laid off, or were you really fired? If you were laid off, I'll bet the new job is at a lower pay grade so they can get someone to do your job more cheaply. Corporate America sucks.
