Today, I found out that my tax filing status was never changed after my divorce. This means I haven't been paying enough and now the government wants its money. FML

Ignorance of the law is no excuse (unless you're running for President, apparently).

This is definitely your own fault. You're responsible for letting HR know if you've had a change that would affect your withholdings. You should have updated a W4 as soon as that happened. If you mean your tax filing status was never changed on actual tax returns that you filed, then you *definitely* deserved it, as you would have either a.) done your own taxes, or b.) used a tax preparer that you should have alerted to your changed status. Seriously, HR and tax preparers are not responsible for knowing what has happened in your personal life.

Hopefully you learn to better be an adult after this. Might be a personal responsibility reason you got divorced in the first place...

Yep been there done that. Not something you think about after a divorce. Ex don't want to cooperate and file together or if kids are involved won't let you claim one you're kinda screwed

I don't think you can choose to file jointly if you are divorced. Also I'm sure there are rules to determine whose dependent the child is if there is a disagreement.

One would think that the parent that has the child for the majority of the year would be the one able to claim them. As for if the time is split equally between both house holds I'm not sure, would they both get to claim the child?

The custodial parent gets to claim the child. If the non-custodial parent wants to claim the child, they have to fill out a form.

My friend got it in her divorce papers that they would alternate years in claiming their son after the divorce. I thought it would be illegal since the child lived with the mother but I guess since the father paid child support (55 a week pshhh) it was allowed.

If you got divorced during the current period, I doubt it makes that big a difference, unless you really made a ton more than your spouse. If there are multiple years then it's your fault for not catching it.
