Your fault for allowing open containers in your car...you can lose your license even if you aren't the one drinking.
You don't get arrested for open container in Florida. They also wouldn't arrest for one swerve (careless driving). These are ticket offenses. And no cop anywhere is going to arrest for DUI without a field sobriety test just because someone "smells like beer". So what was OP really arrested for?
Wow! Well thts not ur fault! The cops r just too stupid to realize tht u had people in the backseat tht were actually drunk! They didn't ask u to step out of the car or anything and walk around?? Well they must have been sum dummy cops. Lol

I would think the real problem wasn't the swerving or beer smell but rather the open container. I don't know about Florida but the states I've been don't allow alcohol to be open in the car.
