Even if you weren't drinking, you were still driving with an open container in the car which is still illegal. You let your friends in the car with the beers. Your friends are douches but you are still somewhat responsible.
In a way you did it to yourself for letting your drunk friends carry "open containers" in the car, duh....you really think you got arrested because the cop thought you were drunk? They have to do breathalyzer & sobriety tests on you & even a bac (blood alcohol content) test before they can arrest you for DUI.
that'll teach you to let your friends drink in the car dummy!
That sucks, OP!! Thank goodness a breathalyzer & explanation of what happened will set you free...
You should have asked for an on the spot breath-a-lyser test.
I think the only person to blame is the police officer... take them to court OP!!!!!
whys everyone defending this guy?? What where u doing letting them have open cans of beer in the car for.... its ur own fault and thats why u got arrested

No brethalyzer test?
I would think the real problem wasn't the swerving or beer smell but rather the open container. I don't know about Florida but the states I've been don't allow alcohol to be open in the car.
