Today, my mother told me how she managed to afford all of the expensive Christmas presents we got. She took out extra money when applying for my student loans. FML

I am 80% sure that not only is taking out a loan larger than what is required to pay for your tuition illegal, but that taking out a loan in someone's name and signing them as responsible for the repayment is illegal. Time to get a consultation from a lawyer, OP.

It absolutely is not illegal. And even if it was, financial aid officers aren't allowed to investigate use of funds as it is a violation of privacy. Source: 3 years working in a financial aid office.

Really, Jeb? because loan councilling at my university clearly tells us that it is illegal to take out more than you need for school/school items (books, dorm, gas, etc.). those loans are for school and school only, which is why we get the wonderful things like no interest for 4+ years. not to buy presents.

And this is yet another problem of Christmas. I hope people can open their eyes to the true plot of Christmas.

If the loan is in your name, and the extra money went to her, she is doing something illegal. I would sue her, and have her pay back for your college loans. People do not understand how that adds up...

This is why you never have your parents cosign your loans.
