That's a tough one. Maybe your friend was just trying to help you, maybe it was just an excuse to bang your girlfriend. I agree with the others, it depends on how far did it go, and if he tried to convince you before and this was a desperate last resort. OP, follow up time. That's the first thing that crossed my mind. I don't condone cheating but secretly filming someone is pretty sketch. Your best friend could get in so much trouble for this.

It's illegal to record video where one has a "reasonable expectation of privacy" (i.e. a bathroom, bedroom, etc.), and it's also illegal to use the footage for malicious intent, or to be used against someone (unless you were stealing or damaging property that it was surveying). The OP (and his ex-girlfriend) could definitely sue for this, and probably get his ex-friend a prison sentence. I think it's definitely something worth looking into.
