There's a big difference between spanking and leaving bruises. If this is someone old enough to watch children, they are too old to claim the playground defense of "she hit me first!"

Unless we're reading different FMLs, I can't see where it says the babysitter "hit" the child. I've volunteered with kids for almost five years, and I had a child try to physically hurt me once, and we had to retrain the child for the safety of the leaders, and the other children. There were a couple of bruises on the child, but that was because they were still trying to attack the leaders while we were required to call their parents. Also, it doesn't specify the age of the child, or the size of the bruises, even if the babysitter had spanked the child, it could have been coincidental bruising, from an accident. Without more information, I feel that people are being way to harsh on the babysitter. Go ahead and thumb me down, but I need more information before I start telling the OP to "sue" them.
