Well here in California, the law clearly states you are supposed to stop and let the pedestrian finish crossing the street before you keep going. So you deserve it.
You're making two assumptions, both of which could be mistaken: The first is that this took place in California (could have been anywhere). The second is that the pedestrian was crossing the street (I got the impression that the pedestrian was going the same direction as OP, probably on a street without sidewalks).
Oh, but your conclusion is correct (OP deserved it), despite your faulty premises--unless somebody cuts you off and slams on the brakes, the person doing the rear-ending is always at fault.
