I'm not a lawyer, but I did play one on TV....:-) While you don't have to consent to the search, there's nothing stopping the cops from dragging out the procedure, taking you to the precinct for questioning, and whatnot. Sure it sounds like harassment, but they can get away with it if they're following the protocol.
Thank you for being the one person on this site who knows what he's talking about. Vehicles don't fall under regular search warrant laws because the vehicle can easily be driven away and disappear in the time it takes to obtain a search warrant.
that is true but all vehicles can be found by vin which the cop shoulda been smart enough to write down if they are going to get a search warrant

Actually, 82 all that is needed is reasonable suspicion, to search a car. . .Which is pretty easy to get at a DUI checkpoint. To a judge in that situation, especially a DUI checkpoint, all that needs to be said to defend himself is "The driver was coming home at a late hour on a road that is a known path on the way home from many bars - The driver made many mocking comments during a serious discussion and I was lead to believe he was intoxicated."
