Today, I bought an iPhone SE, so my mom decided to sell my old iPhone 5 on Craigslist. Since the 5 and SE look exactly the same, she ended up selling my SE instead of the 5 for $100. The buyer refuses to give it back. FML

I would possibly... look into calling the police. I'd consider it stealing. The agreement was for a 5. If they intended to pay you $100, but accidentally handed you a $1000 bill (no longer in circulation) and went on their way, then later realized their mistake and called you to try to correct it- you don't just get to keep the $1000 bill.

But the buyer agreed to the 5, not an SE.

honestly YDI for letting your mom sell it and not making it clear which one was the 5. Hope you learned your lesson.

Based on the wording OP used, I don't think they "let" their mother sell it. I think OP's mother decided to sell it and not tell OP until she had already made the transaction with the buyer.

If the phone had been activated (Apple ID , find my iPhone,passcode ) she only has to request the phone to be locked all she needs is to log on to itunes through a computer and she'll see what phones are registered on her account and their emei what ever it's called then she can get the phone locked go on find my iPhone that will give her the location and call the cops hope it's sorted op I feel for you

That's thievery! He took the wrong product, even though he paid for it, and if he refuses to correct the mistake, then he is stealing your IPhone SE.

No he isn't, since the seller still sold it to him. If you go to Walmart to buy a MacBook Air and they mistakenly give you a MacBook Pro, it's the seller's fault and you're not obligated to return it to correct THEIR mistake. It's their fault for being negligent. No police station would come to confiscate it after the transaction is done and you take the MacBook Pro home. My dad's a cop, I asked him about this because everyone in the comments seems to be under the notion that the buyer is supposed to correct a mistake of the seller, which is not the case

Looks like your mom should be buying you a new phone. If I were her, I'd feel really bad for my mistake and buy you a new one. Let's hope your mom is a decent human being.

Update: we did manage to sell the 5, and my mother got me a new SE and case (I had moved my 5 case onto the SE, which contributed to the confusion). I'm even posting this update from it! She was really apologetic, and said that she would confirm with me before selling stuff next time.

A lot of lost money that could've been avoided with double checking am being more careful.

I voted FYL, because that's a shitty thing to happen. Part of me really wanted to say YDI for using apple products in the first place X'D I kid of course. Glad it all worked out OP!

Doesn't matter. When someone responds to an online ad for a product, goes through all the steps and agrees to buy it, it's like a contract. "I will give you x, and in return, you will pay me x amount," or vise versa. In this case, the deal was for an iPhone 5, not an iPhone SE, the buyer knew it was for the 5 because he saw the ad, that's what he agreed to. He paid the price for an old iPhone, not a new one, by keeping the phone that was not in the agreement, he not only violated this contract, but it's considered stealing. Think of it in terms of a regular store, example) Walmart sells an iPhone 5 for $400 and the iPhone SE for $600. You go to buy the 5 and pay the $400, which is cheaper than the SE. The whole transaction is for the 5, both you and the store have agreed to this. However, the cashier accidentally gives you the SE instead. Now, when you or the store notices it's the wrong phone, considering that you did not pay for the SE, if you don't amend the situation and give the phone back, this is stealing, isn't it? Because you are in possession of a product that 1)you didn't pay the proper price for, and 2) the transaction and agreement shows it was not for that product. Well, this is all the same for less official transactions between people.

She sold something that wasn't hers, she is responsible for her actions she either needs to get you new phone back and give that person your old phone( if you wanted her to sell it for you) otherwise she has to buy you a new phone. If she doesn't then call the police. Can't wait to see you to on judge Judy

OP had already followed up saying their mother replaced the phone she accidentally sold.
