I agree with you whole heartedly, but because they're not married a lot of states in the US have the wedding ring as a clause of a contract. If Marriage doesn't happen, the purchaser is legally allowed to take it back/go to claims court over it. (Even if he messed up the pending marriage!)
Not if you can prove infidelity on the purchaser's part. Him cheating means that he broke the contract first so pretty much any judge would tell him to beat feet and encourage her to do whatever she wanted with the ring. Bout a decade ago the supreme court ruled the ring a gift in cases like that when a guy took the ring back, stole his ex's stuff, and gave it all to his mistress. It was a pretty nasty battle.
