Agree with Autumnatic completely. Do what you must do within the requirements of the law. Just remember to thank Daddy for dragging you into the thick of this, when you've expressed your wishes to both parties clearly in the past. FYL, for now.

While it's true that the 5th ammendment does not apply here, and there are not any federal laws preventing you from being compelled to testify against a non-spouse family member (that I'm aware of), that doesn't mean that there aren't state laws providing that protection. Without knowing any details of the case, I wouldn't want to comment on the probability of the judge compelling you to testify if you declare that you don't want to - it can depend on the case, and on the judge - if he does compell you and you remain silent you can face fines / jail time for contempt of court, and you should definetely show up, but if you're really against it, simply respond to all questions by stating that you were on the moon. "Where were you on July 11th, 2006" "I was on the moon" "What can you tell us about the events that took place that day in August 2002?" "I don't know, I was on the moon. With Steve." "Did you brush your teeth?" "I was on the moon" or "I don't know, I was dead at the time!"

You might be required to show, but you aren't required to testify. Read up on the fifth amendment. :-)

Go to jail. Don't compromise on your principles. You're in the moral right anyway, I doubt you'll be in there for more than a few days.
