OP I had the same experience. I got into an accident (wasn't my fault) and one side of my car was hit. Then the tow truck driver ripped off the other side.

Sue them for damages. I think this would overrule whatever violation caused them to tow you in the first place.
It wouldn't. First off, the post says the tow was because the car had broken down, not for a violation. Secondly, you don't pay a violation to the towing company, those are two separate entities...

First call should be to your insurance agency to report the damage that the tow truck caused. Also, make sure that you take pictures of the damage. Although having a good lawyer on retention is not a bad idea, the insurance company is better equipped to handle this situation.
This. You file the claim with your insurance, and list the tow company as the "Responsible Party" for Services and provide the details. Your insurance is in most cases able to get your vehicle repaired faster, and they'll seek reimbursement from the tow company.
Pretty sure that towing companies are required to have insurance because of stuff like this... Or is that dependent on state?
Most major tow companies carry between one million and three million dollars worth of coverage. The ones you have to watch out for are what are called "one hit wonders" where there is only one truck and one owner. They are the ones less likely to carry any sort of coverage and if some damage happens to your vehicle, you'll be hard pressed to get anything to fix the damage. If you ever need your vehicle towed, it's perfectly acceptable to ask about their insurance in case of an accidental damage. Also, don't skimp on what you'll pay for a tow. I know it can add up, but those who will do a 5 mile tow for $50 are going to be in a rush and more likely to damage your vehicle. I would also look at their Yelp ratings. One or two bad reviews is normal in the industry but if there are more than that call someone else.
