They are required to mark it, so it's hard for me to believe this would happen because of all the precautions that they go through before surgery. The IV is on the other side etc.
They're supposed to mark it while you're awake. I'd sue.

One of the few times I would actually suggest suing. I have heard stories of people drawing arrows and notes on themselves to ensure the surgeons work on the correct limb.
