Unfortunately, most states are no-fault states. Even with proof, the courts will not care. He could be cheating on her with the whole office and it will still be split 50/50.

While I'll agree that it's entirely possible that this is the first time this has happened, and the husband had no prior knowledge of this... It's way too coincidental. OP just happened to have the wrong phone on the first occasion? Highly unlikely.
