Today, my roommate found an eviction notice on our door for unpaid rent. Our apartment building caught fire and we haven't been living there for well over a month because it was legally unlivable. Today was our first day back. FML

Pretty sure that's not going to hold up in any court in the universe.

That burns. Things could get pretty heated when you try and fight it, but maybe they'll fire the apartment manager and you can have your home back!

Actually, you need to first look at your lease to see if it contains a provision for s situation such as this. If you're dealing with a larger leasing company it should. If it doesn't get an attorney to respond.

Fight this! You can't pay rent on an apt. that you can't use.

Act quickly and properly, OP. These notices have short reponse times, and you don't want to lose your rights by being late or responding incorrectly. Some good tips above. Best of luck.

A far as I know, you still have to pay rent if your belongings are there. Check with a lawyer! You can fight it but you'll have to pay the back rent. Sucks, I know!

BTW, you don't usually get an eviction for one or two missed rents! It's 90 days most of the time! Something's funny about this story!

Your insurance company should have paid the rent. Also, the lease agreement and then your Renters Bylaws in your district. Hopefully, you're not liable to pay but my guess is that you actually are.

I'm fairly certain that they can't evict you for not paying rent on a place you are legally not allowed to live in. Especially seeing as how it was due to fire. If they are I distant I'd say get a lawyer to get you what you need.
