I don't know how things work where you live, but in South Carolina, if part of a neighbor's tree is hanging over their property line onto yours, you have all rights to cut down the part hanging over on your property line. So if the part of the tree that fell onto your car was hanging onto your property, then it was your fault, and not theirs. Now, if the entire tree fell over onto your car, then it IS their fault.
Their property damaged your property. Sue in Tort.
if you didn't warn them about it, it's an act of nature/God.
