Read it from a card. Here in New York State they hand out the cards all the time. If you go to court then you tell them you read it from a card because if you said you memorized it and mess it up in court they will question whether it was read right.
I learned something new today. Would a case be thrown out because the Miranda rights weren't read properly?
yes, if you're not properly read your Miranda rights the case it's a mud trial
Will that hold up in court?
That;s why you ALWAYS read Miranda from the card. I don't care how long you have been doing it (for me, going on 24 years) but I always read from the card. Yes, most of the people you deal with know their rights better then you do (which is why I feel it's antiquated to read it) but still if you do it from memory, some defense attorney will get you on the stand, when he/she finds out that you read it from memory, expect to be told to do it right then in court. Use the card and a digital recorder to confirm that you did it. I'd shut down some defense attorneys who claimed I never read miranda to their client when I sent them the audio recording. Hard to argue with that. My advise to you is to carry a recorder and use it. And in asnwer to Sonnyroas, the case may not get thrown out but any statements elicited after the faulty Miranda wraning would be suppressed and not allowd in evidence. It doesn't necessaritly mean the whole case is trashed depending on what other evidence. And, contrary to popular believe, LE does NOT have to read you your rights if they have intention of questioning you or if the questioning is non custodial. Like many things, it's not like the movies or television which are almost all total BS as far as procedures go.
I think it's bs anyway to have that much riding on a simple thing like this. Just like cases which get thrown on tehcnicals...
He dumb for helping you because if you don't say his rights he get released lol. If I ever get arrested I hope it's your dumbass.
I was starting to forget how unprofessional cops are thank you for reminding me

I find it hilarious that he knows it well enough to recite under pressure yet its your job to remember it and you mindblanked.
