Today, my boss fired me for "fooling around" on my phone. I was looking for supplies for a surprise party we are throwing him for his birthday, and I didn't want to do it on my work computer because he has access to our history. Also, this happened during my lunch break. FML

Talk to HR he can't fire you for making personal calls during your lunch break. FYL OP.

Hire a male stripper to come to the party and serve your boss with the papers for your Wrongful Termination lawsuit. Pay the extra fee to get him to bring the summons rolled-up around his penis.

I hope you talked to HR. I'd send him a letter on his birthday telling him what was going on. Make him feel like an asshole. I hope you didn't REALLY need that job. I wouldn't go back if he asked me to.

There has to be more to the story. No one gets fired for using there phone during lunch.

It sounds like he was looking for a reason to get rid of you. Still, if you were on an unpaid break, he couldn't have fired you rightfully until you were back on the clock. Also, if you were past 90 days of employment, at least where I work, he would have to write a formal termination letter. Weird stuff all around, this is.

He can't legally do that. You should know your rights. Look at the EEOC website and get a lawyer

Yes he can. Employment at will.

On your lunch break you are free from company policy and must follow local laws, phone calls are legal, so is browsing the internet on your phone.Call HR, what he did is illegal, instead of throwing him a party, it'd be fit to throw him a going away party

If it's an at-will state he can fire the OP for just about any non-discriminatory reason he wants.

Look at it this way. Now that your not working for him, you can call him bad stuff to his face.

Unemployment benefits, ask for a mediator, then drop the bomb on him in the interview. Collect your benefits, don't feel sorry for his actions.

Sue the company. No way that's legal.
