did you make your trunk go up really quickly? usually it just raises an inch and stops.
It's probably an automatic.
How on earth did she get hit under the chin unless she was leaning over the back of your car?
Doesn't Texas require car insurance? Call them and get them involved they will have to pay not you. People don't realize that you don't get money for suing it's a waste of time. The insurance company will pay anything medical. Then she bring the insurance company to court she gets nothing more than lost wages if anything most people have sick time at work so there's no money there. They DON'T PAY pain and suffering that's a myth or lawyer fees. So the insurance only pays the remaining medical bills and then 1/3 of it goes to the lawyer and she's left with paying the 1/3 of her medical out of pocket.
Maybe you haven't ever seen pain and suffering pay out but I used to work in a personal injury law office in Oregon for 4 years and nearly every case was awarded some amount of pain and suffering. I've seen pain and suffering up to about $200k for a teenage girl with a permanent scar on her face that was easily coved by makeup and I've seen it as small as $1k in a fender bender because treatment for his neck injury ate into his weekend time.
Umm the first question needs to be asked: Why was she so close to your car? If you have a van where the trunk opens up all the way, the flashing lights should have warned her to move on quickly. If you don't have a van like that, but a car with a trunk you have to lean over in order to get hit in the chin with, then there is the question of WTF was she doing? Peeping into your car to steal something? She might be an elderly woman, but that doesn't allow her to peep into others' cars.
For any type of vehicle you would have to be standing a certain way to get hit in the chin. For a car you'd have to hover over. But walking by a van/suv you'd be hit in the side. There's really no logical way for her to have been hit in the chin other than she did it on purpose
How fast does your trunk open? Certainly not enough to cause actual damage? I hope everything works out in your favor, op
Seems very fishy on her end that she happened to be so close to your car to get hit, hopefully all ends well.
I'm a criminal justice/law major and she has absolutely no case. It wasn't intentional and if it hit her chin she was facing the back of your car looking into the trunk to begin with. She wasn't injured from what you said she was able to walk away fine. She's just pissed. Counter sue if she actually follows through for any fees for your lawyer and then some for the inconvenience. Don't take all she has but a nice check to cover her annoyance
That's hilarious

Why was she so close to your car in the first place?
Why didn't you check if somebody was around? Though she doesn't really have any grounds to sue you, you should have apologised. Hope you did OP.
