If you guys were in California, your dad broke the law.
Unless you were actually hurt in the accident or he was driving your car at the time, then I wouldn't necessarily consider this an FML. I'd be curious to know if it's more because you had been talking to him and not just the phone call, or if either is actually to blame (it could actually be neither). I'd say FHL, but he was kind of asking for it to happen. He deserved it. Karma wins.

I know this family and even though the dad was being a hypocrite, the accident would have happened regardless of whether he was on the phone or not.
Either distract him more and hopefully get rid of all the distractions, resulting in a MUCH SAFER trip, or let him be distracted the whole way, potentially getting into accidents?Your choice.
And you know that due to you psychic ability? Accidents don't always just happen whether or not someone is on the phone, driving distracted can be a factor in accidents that could have been avoided
