False. It's company property. It might feel like an invasion of privacy however you have no expectation of privacy in an open locker in a common area. Search is legal. Termination for not following rules is legal. Furthermore most states are at will meaning employers can fired you at any time for any reason. All completely legal.
#52 is right. In most cases, whether or not your in an at will state, companies have a 60 or 90 day probationary period where they can fire you for any reason. And I can guarantee you that OP signed an agreement to company policy when hired, which would have included the policy about cell phones in the work place. OP is lucky she had her own locker, because where I work, we all keep our belongings in the same drawer, by policy. You don't like that people can go through your belongings? Don't bring it to work. Believe it or not, people have had jobs for a long time without needing to have a cell phone in their pocket.

ydi, nothing that happened to you was illegal, you had rules to follow at your job. didn't follow them so you got fired.
How about leaving it in your car? I assume your workplace has phones unless they interfere with things so you could use those. It sounds like you don't really need a phone with you for your job. Leave it in your car or at home. That's what a lot of people have to do.
There is probably more to this story than OP is saying. Probably did not leave it in his picket and was warned. Probably why his locket was searched.
