Today, I agreed to lend my daughter's inflatable pool to my neighbor for the day. Barely an hour later, I witnessed his son jump off their balcony, missing the pool by inches. He's now in hospital, and my neighbor has sworn to sue me, saying I'm responsible because the pool is mine. FML

Once they took the pool to their property it was under their care, custody and control. You have no liability.

I think they would get laughed out of court before making it very far. After all they own the balcony (and the boy..), it's your pool (under their possession) but only 2 of those 3 things are responsible for the stupid and easily avoidable accident..

They can try to sue, but it was their property, their son, their lack of supervision, their balcony.... Dumbasses never cease to amaze me. Jumping into a pool from the balcony and missing the pool as well.... Really?? That part makes me bust a gut!

That argument would never hold up in court. It's the parents fault for not watching their child. It being your pool doesn't make you liable for damages.

Don't worry that won't hold up in court. It was his sons choice to do what he did. And I probably wouldn't lend anything else to that neighbor.

Tell him to jump in a pool… lake.

The reality is that with a good enough lawyer you can probably sue someone for being ugly.

Just think of it as evolution in action

The pool wasn't on your property and you didn't force or dare the kid to jump into it from that height. FYL, but I hope the kid is okay.
