Today, I caught a man standing on my porch, urinating on my house. I called the cops, who informed me that because my porch isn't fenced off, it's not trespassing, and because it's private property not visible from the street, the man wasn't urinating in public. FML

A little more detail: This guy had wandered over from a party next door. It was almost 1 a.m., and during the holidays I work really late, so I came home, put my stuff away, and when I turned around there was a guy standing literally at my window, on my porch, pissing on my house. I walked out and started screaming at him (I know, probably not smart) to get the **** off of my property. He said, "I'm just takin' a leak," finished his business, zipped up his pants, and leaned against the porch staring at me. That's when my brain caught up with what I was doing and I went back inside and called the cops. My porch runs the length of my (very small) house. The porch is open without a railing, and at this time there were also several other men sitting on my porch right under my bedroom window (closest to my neighbors yard). When I called, Weld County dispatch first told me that the police were "too busy" to come out, and I ended up on the phone with a cop. He asked if the porch was fenced (no) and if it could be seen from the main road (no). I stupidly thought he was trying to locate my house, as it is hard to find. According to the laws in my city, once you ask someone to leave your property and they refuse, it is trespassing. I told them multiple times to leave my property, and one of them had the nerve to tell me "I can sit where ever I want."

He's still damaging your property, so he could be charged with vandalism or a similar offense.

Well since said property is not public and the man is "not" urinating on your house, I guess you could "not" take a iron skillet to his genitals. Just a theory.

Since it "isn't public" there wouldn't be any witnesses.

Well they're contradicting themselves by saying that it's private property. Was it that man's private property? No. Then he was trespassing.

The law may be different in whatever state he's in but at least where I live unless you have a fence line you have to tell them to leave and they must refuse before it becomes trespassing.

Well then let's add it to the list of dumb laws that make no ******* sense. If it's private property the very fact that the owner does not want them there should count as trespassing. Just because you don't have a fence on your front lawn doesn't mean it should be okay for just anyone to walk on your property. Regardless of the stupidity of the law, what's really wrong is the stupidity of the officers that refused to respond to this. OP said they asked the man to leave and he refused. If that's what it takes to be trespassing then the police should've come out right away. Report them OP. your safety was at risk and they refused to help when they should've come to help you. It's their job to enforce to the law and they (the loitering assholes) decided to break it.

I have a feeling the guy will defiantly be pissing on your porch again. It's definitely trespassing and indecent exposure and public lewdness, etc.

I would try to get another charge put against him. If that doesn't work.... Build a fence around the porch and put a no tresspassing sign up.

Did you know who the man was? It doesn't take that long to pee, not much they could do if it was just a random dude, unless you detained him somehow, anyway.

I would call the police saying "I just called a minute a go to complain about some man peeing on my lawn. And since it's private property, I shot him. Its ok though, no one saw it from the street." Then hang up. Watch all the police cars show up an catch him red handed.

You have no idea how close I came to saying something just like that. : I called dispatch a second time to try and get some help, and the lady told me, "there are people being shot at right now!" It was on the tip of my tongue to reply, "There will be people being shot at right here if I don't get a cop out here." Just in case anyone's wondering, I researched that statement as well, and there were no reported shootings in my city that day. As far as guns go, I do have a gun, and I did have it at hand. However, the use of deadly force is not permitted in my state against someone who is trespassing on your property unless they come inside your house or it is clearly in self-defense. I was not about to stay out there long enough to need it for self-defense.

I bet it's cold where you are. Lazy ass cops just didn't want to go out in the cold. I'd report the incident to a higher authority, so they'd know what a bunch of lazy assess are in their police force. Although probably nothing would come of it, it won't hurt to try, and while it won't change what happened to you, it might help make for a better police force in the future.

Please take that to your local sheriff, news, somebody. The police are flat out refusing to protect someone who is in a very, very scary situation. Start asking questions, like what their follow up procedures are after those men looking in your windows break in, kill someone, rape someone, etc. Preferably, ask these questions in very, very public areas. Embarass the hell out of them.
