I don't know what email provider it is but Yahoo accounts seem to be particularly vulnerable to being hacked to send out spam ads. Yahoo has a help section and when you get the bad email, if you click on spam, it gives you the option to choose "my friend's email has been hacked." So they are trying to fight it. Maybe that is a lead you can pursue.

If somebody hacked his account and did this, they should be found and hanged by their testicles... Sorry OP for having this happen to you. Dealing with the loss of a relative is bad enough ... nobody needs that shit on top of it.
