I've gotten one of these too. If you read the fine-print at the bottom, it says that the camera is infallible, and unless you reported your car stolen, the registered owner of the car is responsible for the ticket. The only other way to get out of it is if you have already recieved a citation from an actual police officer for running the red light. I've had police officers admit that the right-light cameras are not about public safety, but are simply a cash-cow, designed to generate huge amounts of revenue. If they were about public safety, they should add points to your liscence, but they can't prove who was driving most of the time, so even if you let someone borrow your car and they run a red light, it's your car, and that makes you responsible.
It doesn't matter what the fine print says, the judge has the final say, and no judge in their right mind would hold you accountable, IF you can prove you were rear-ended at that light at that time. Otherwise, they are forced to assume you did it. Especially since in your story, you didnt even really run the red light, just sorta ended up in the middle of it
Yeah I agree that you shouldn't have to pay for something like this. It just feels like the cops found some loophole they used to still charge you with the ticket.
Unfortunetely you still have to go to court...make sure you bring the police report to the court date. Wouldn't hurt to find out what district the officer who wrote the report works from and go pay a visit to ask him/her about the situation, though. The sad thing I heard about some of these red light cameras is that due to the cost of purchase and maintenance from a third party, a majority of revenues don't even go to the cities that have this crap. Have fun contesting the ticket though:)
This would be dismissed so fast in court it's not even funny.
on the ticket it should say your speed, and if it does and you were rear ended then it would be about 2mph. or something really slow. so you should be able to fight it.
Theres no way that will hold up in court. they cant prove that the owner of the car was driving, and the pictures arent that good (sorry national treasure 2...)
