If you can't sue, you can also take solice in the fact that. They won't make it because YOU wrote the song... when it comes down to it. who writes the next one for the band? Nobody.
dude so what if it was on a local radio station and it's "the first single of their new lp". do you know how many shit bands have lps now? in this age, everyone and their mom is recording music, and my old band was on our local rock station several times. it's not hard to get on local radio. right now you have nothing to worry about, but if the song blows up then you gotta take some legal action. that is if you actually have any way to legally prove the song is yours.
25 - I totally agree! Just relax, let it take it's toll. I was the singer for my old band...then one day I was on iTunes and TWO of my songs popped up!!! With a picture of THEM!!! All I did was call up my old producer and scare him into me taking over the rights. He fell for it! Because he KNEW I had sole rights! There's nothing that he could've done! I'm still on iTunes but because I'm not with them anymore...legally they have to put me on as FEATURED on the song that I WROTE & SANG for them. But I can't bitch bc I get a cut of royalties. :-) Op, I'm sure you have proof of rights and a way to contact them. Just do it the right way.
Not to sound nosy, but what type of music did you sing in the band?
96 - I'm a blues/rock singer. Think of a pile of shit meeting a box of dead cats, with vocals of Christina the parrot and the lyrics of Champion the Wonder Horse. :-)
sue for copyright!!!!!
If you can show you wrote it, ask for a percentage of profits. If they refuse, sue them for copyright infringement.
OP says he moved, meaning he probably moved far enough away from his band mates that he couldn't play with them anymore, meaning that the song is at least playing on a station in a surrounding local area...possibly further depending on how far away OP moved, not OPs original home where the band stayed. It's highly unlikely he could prove he wrote the song at this point, and it's entirely possible OP had help with the song from his bamdmates, therefore he's not entitled to full rights.
if the band was smart, they'd have gotten a copyright on it before he could come back and say wish I wrote this
*woah not wish. ....stupid iPhone
32, 35 - being a singer/songwriter I do know a thing or two. Regardless if he had "help" with ANYONE in the band, if their name(s) are not on the original or FINAL DRAFT of that copy (wether typed or signed) they have no right. End of story. At the end of the day it's Op's song that he wrote. He deserves just as much as the band is getting. Whatever that may be. Now of course, there are always two sides of a story...so I'm just going with the assumption that op is correct and crossed all his T's & dotted his I's.
penatik - your welcome! Just here to help if I can! And I understand what you wrote now. lol
FFR, lots of US screenwriters mail a copy of each draft to themselves and file it away unopened. If there's ever an authorship dispute, they then have an original copy that's sealed and officially dated, with the postmark as proof. It isn't foolproof, but it's cheaper than copyrighting everything. The same idea could work here.
23 I doubt being on a local radio station with 1 good song will get you big enough
33 - they can if they play their circuit well enough (i.e. gigging & merchandise, website & radio promos and events) ...they have a great chance, in that matter which is why op just can't stand around.
What is the name of the song and the band
42 - yeah I'd like to know that, as well.
dude that is great for u even tho u r not in the band u still get paid off ur work
or get you laid either one
Keywords
you really should sue them or sth, what if they become the next big thing with a song that you wrote?
What assholes >.>
