Phones now have something called IMEI, if OP reports the IMEI of the phone as Lost/Stolen, no network will work with it. So yes you have the phone, but whatever SIM you try to use won't work. If you have an iPhone and there's no security lock... the person who stole it can turn off Location Services, you won't be able to track it :/
Was this in sideswipe in the herald?
At this point, you could either A) GPS track it, B) Call your network provider to block the phone, making it completely useless, or C) Call the police. Don't let that asshole get away with that shit.

A similar thing happened to me. I told the guy who basically stole my phone that I would pay him 50$ for the phone back...he said 100$. So I said sure 100$ is fine. I went to meet him and asked to see the phone to make sure it was mine. Then I snatch the phone out of his hand and said FU! And left with my friends...maybe you can still do this.
