Why is 17 voted down? If OP is harmed and the biker doesn't have insurance to cover it, its the law's job to ensure OP's made whole for his losses.
Well no, they were biking on a public trail. Also the bikers could easily sue her for damage as well. Most trails tell you to give way to bikers. If the bikers had to try to avoid her, and couldn't, then she was probably standing right in the middle of the trail. Have you ever gone biking on a trail? If you have, you'd understand how frustrating people can be.
Lesson to be learned? It's sometimes hard to see around corners on a trail.. Depending on how fast the rider was going, he could have locked up the brakes but slid into OP. Plus it's harder to move off a trail quickly on a mtb. Most trails I ride at gives bike riders the right of way.
