You can take them to court on that basis! Not a formal letter, joking manner. If it was a prank from someone on his phone you then will be laid off as a no show! Escalate to HR!
I have to agree with all the others. Unless there was something entirely unrelated in that text that the lmao was referring to...No. That is not at all appropriate. Contact his higher-up and let them know what has happened, and ALSO contact the HR department. Let them know that one of the employees is being very unprofessional and may need a refresher course on proper protocols for hiring, firing, and laying off. He sounds like a grown-up bully IMHO unless he just really, really, really struggles with people skills. Even then...No.
