Who says she let him have it? Three-year-old kids have figured out the use of their hands and can open drawers and get things out just fine by themselves.

#63 you fail to understand responsibility. OP was paid to watch the kids, regardless of how or why the 3 yr old got a paint pen, she was in charge so 100% of fault lies with her...with your ideas of what is acceptable responsible behavior I hope you don't breed
Since the FML doesn't reveal the oldest child's age, it could be that he was old enough not to have supervision the entire time (but still need it of course) and OP could have been helping the other child with something else temporarily. Of course we don't know their situation, but I agree that OP kind of deserves it.
It did reveal it...he's three.
Picture this scenario: you're babysitting a 6 month old and a 3 year old. The baby has a disgusting blow out diaper. While you're changing the diaper and you and the baby are covered in poo, the 3 year old opens the door and runs into the hallway. Is it conceivable that OP was being responsible but the 3 year old was still out of sight for a few minutes?
At the ripe old age of 3, he knows when he's in trouble, and how to pin on someone so it sticks. Wonder where he learned that? Sharpie talent, for a 3-year-old ;) Be glad you're out of there, OP, before he burns the house down and accuses the babysitter of arson.
