To be fair, why is your 5 year old left without supervision long enough that he gets into the neighbour's yard? Watch you kid!

This could go either way- either you're a bad parent or he's a bad neighbor... Guess we would need a whole for story for that shit tho, and in the words of one Sweet Brown: "Ain't nobody got time for dat."

It's quite possible the neighbor is a crotchety old geezer who hates kids. If that's the case, then putting up a fence without talking to you first is a bit extreme. However, it's more likely that your son is a little terror who makes Dennis the Menace look like an angel and does damage to people's yards when he "plays" there. Have you been asked not to let your son run wild all over the neighborhood? If so and you haven't impressed this on your little brat, then YDI.

Can't this be classified as child abuse? Maybe? Endangering the welfare of a child?

Not really, he's installing a fence around his house to keep trespassers out, not directly trying to harm the child. It'd be child abuse if the neighbor tricked the kid into walking into the fence or if he chased him with a cattle prod everytime the kid got in.

Electric fences are cheaper. Still pricey, but cheaper. They can also be installed onto an existing picket fence or other ineffective fence. The actual solid fence doesn't need to be anywhere near as strong or well-anchored...it just has to be enough to put a bunch of 4" plastic pieces on and string a wire.

I'd do the same if my neighbor had an irritating child who can't keep his antics on their own property.

you do understand that in order for the "Electric Fence" to work. properly,your 5yr old who you clearly can not watch long enough to keep out of trouble, needs to WEAR A SHOCK COLLAR. So unless you plan to keep a shock collar on him it wont work.

electric fences aren't electric colars, they are physical fences with charged wires that will shock anybody who touches them

Did you know there's more than one kind of electric fence? Such as one made of wire that is electrified? Google is your friend.
