You file your taxes in February (give or take) for the previous year - January 1st to December 31st - everything earned in this time frame. So... how not?
She isn't smart. If she knew the tax code she would know that unless u have a divorce decree stating u are legally divorced u are still married for tax purposes. And filing married separate is the worst filing status is terms of getting money back. Married filing joint is the best. So she's really not doing herself any favors by waiting.
If you want to get back at her check if this is something she can be punished for, if it is then it is just a matter of sending the right information to the right people
