This happened to me at a MAC once, too! I took out my six-month-old MAC lipstick without thinking and put some on, only to be tackled by security guards. I then showed them the wear & tear on the label on the tube, and the fact that there was less than half an inch of lipstick left, and they very sheepishly backed up and mumbled apologies after that. Idiots.

Its called the Merchant Detention Act, But they have to have probable cause to stop you, and they need what is called Elements, which are SELECTION, CONCEALMENT, MAINTAIN 100% OBSERVATION and PASS ALL POINTS OF SALE. If they don't they could get fired and you could sue them. and if they placed you in handcuffs or held you for a very long time you could sue for false imprisonment. you should talk to an attorney. and you shouldn't hate all of us just the ones that think they are cops and they have power trips.

Dude, the same thing happened to me once. Except it was even sadder. I had an SAT practice book with me, one that I bought from the store. The sensors didn't beep when I went in, only when I went out. Almost getting arrested for allegedly stealing an SAT book. That's the saddest way to go own.

Charge them with unlawful detainment, sue for defamation, blog it to the consumerist, there's no end to the places you'll go!
